What Is a Guardianship?

There are two types of guardianship — guardian of the person and guardian of the property. A guardian of the person is responsible for personal and medical decision-making on behalf of a mentally incapacitated individual. A guardian of the property is responsible for financial decision-making on behalf of a mentally incapacitated individual. Most often, one person will serve as both guardian of the person and guardian of the property. However, sometimes, one person may serve as guardian of the person and another may serve as guardian of the property.
