It is common for a disabled adult to receive governmental benefits, including but not limited to Supplemental Security Income (SSI) or Medicaid. However, to be eligible for these benefits, these individuals must meet an asset and low income standard. A sizeable personal injury recovery or inheritance could make the individual ineligible for benefits.
At the law firm of Kelaher, Garvey, Ballou, Van Dyke & Rogalski, P.C., in Toms River, our attorneys are knowledgeable in all matters related to special needs planning. Our lawyers are skilled in drafting Special Needs Trusts and Supplemental Benefits Trusts to hold assets for the benefit of a disabled individual. We assist clients throughout the New Jersey Shore and surrounding areas with special needs planning and other estate issues.

Special Needs Trust
A Special Needs Trust is created after a personal injury recovery to hold assets for the benefit of the insured individual. Rather than transferring the compensation directly to the individual, the assets are placed into a Special Needs Trust so that the individual will still quality for government benefits.
Supplemental Benefits Trust
A Supplemental Benefits Trust is created to transfer an inheritance, or other assets, for the benefit of a disabled individual. Rather than distributing the inheritance outright to the individual, the assets are placed into a Supplemental Benefits Trust so that the individual will still qualify for government benefits.
